1. Scope
www.gengigel.ch shop is the online shop for Gengigel® hyaluronic acid from the manufacturer Ricerfarma, srl/Italy, distributed in Switzerland by iBF-next GmbH, UID: CHE-260.849.767. The present contractual conditions ("GTC") regulate the rights and obligations of the operator of the web shop and its customers in connection with the purchase of goods and are valid for every purchase via the web shop of Gengigel.ch.
2. General
The products are divided into products for adults and children, as well as products for the dental profession. All products are in free sale, whereby the products for the dental profession are only handed over after proof of the ZRN number.
3. Information about products in the web shop and their use
Instructions for use are available for download for all products. iBF-next GmbH is careful to provide correct product descriptions, but these may differ from the manufacturer's description.
iBF-next GmbH assumes no liability for the correctness, topicality and completeness of the product descriptions and product images.
The offer is limited to the areas of Switzerland and applies exclusively to private or personal use.
4. Order and conclusion of contract
4.1. In general
The products and prices offered in the web shop are non-binding offers.
Registration is reserved exclusively for persons over the age of 18 residing in Switzerland. By sending an order and simultaneously accepting these General Terms and Conditions, the customer submits a legally binding offer to conclude a purchase. The contract is concluded upon receipt of the order confirmation by e-mail. The customer assures that the information given when ordering in the online shop is correct.
Each contract is subject to the condition precedent that the goods are available. If the order confirmation indicates a lower quantity of goods than the customer ordered, the contract is deemed to have been concluded with the lower quantity.
5. Prices
5.1 Prices
All prices are in CHF and include VAT, but do not include shipping costs, which will be invoiced separately unless free shipping is explicitly stated. All costs and the total are displayed at checkout. Technical changes, errors and misprints are reserved. Prices may be adjusted without prior notice.
5.2 Benefits
Products in the web shop to which discounts apply are specially marked. In principle, a maximum of one discount can only be redeemed on the sales price of these products. Promotional prices, promotions, reduction vouchers and promotional codes (can only be redeemed in the web shop) count as discounts.
5.3 Shipping Costs
When ordering goods in the online shop, the shipping costs are calculated by weight and automatically shown in the ordering process. From a certain value of goods per order, which is specified at the time of purchase (including VAT, but excluding shipping costs), the provider assumes the shipping costs
6. Terms of payment for orders in the web shop
The customer can use the payment options specified when shopping in the online shop. When paying by credit or debit card, the data is transmitted in encrypted form. iBF-next GmbH can use the customer's data to check his creditworthiness when choosing payment methods.
7. Delivery for orders in the web shop
The goods are generally dispatched on working days within one to five working days after receipt of the order. If an order contains goods that are not in stock and cannot be dispatched within five working days, the order will be executed in several stages, of which the customer will be informed. This does not result in any additional delivery costs for the customer.
If the customer has specified a delivery address other than his own during the ordering process, the customer is liable for shipping to this address.
The delivery is made to the desired address in Switzerland.
Use and risk pass to the customer upon handover to Swiss Post.
The customer acknowledges that the ordered products are delivered via Swiss Post, although Swiss Post can also hand over the shipment to a person living in the same household, so personal delivery is not guaranteed. If the customer has made a separate agreement with the post office, delivery will be made to the agreed address.
8. Exchange, transport damage and warranty
8.1 Exchange and damage in transit
The exchange of pharmaceuticals and medical devices is generally excluded.
The offered goods leave the warehouse of iBF-next gmbH in perfect condition and can basically neither be returned nor exchanged. The only exceptions to this are goods that were delivered incorrectly or goods that should not reach the customer free of defects. In these cases, the goods are to be sent back to iBF-next GmbH in their original packaging - insofar as defects have been reported to customer service in advance - and the customer will receive a replacement delivery if delivery is possible, otherwise a refund. Subsequent changes to orders that have already been confirmed are excluded. Defects must be reported in writing within 2 days of receipt of the products. Otherwise, the products will be deemed to have been properly accepted.
In the event of transport damage or if the properly shipped goods do not arrive at the place of delivery, the customer must contact the logistics company directly.
8.2 Warranty, Liability
The provisions of the manufacturer apply exclusively to the warranty for defects in the goods. iBF-next GmbH expressly excludes any further warranty. However, for quality assurance purposes, the customer is asked to notify us of any product defects.
With the exception of mandatory liability cases (product liability, intent and gross negligence on the part of iBF-next GmbH or its auxiliary persons), iBF-next GmbH completely excludes any liability (ie also for auxiliary persons).
9. Privacy and Changes
iBF-next GmbH treats the personal data of customers as strictly confidential. The customer is informed, however, that the data recorded as part of the conclusion of a contract can be collected, processed and used for marketing purposes to fulfill the obligations arising from the purchase contract. However, only the data that must be passed on to commissioned service partners for the performance of the service (e.g. addresses for the attention of logistics partners) or only communicated to third parties for the purposes stated in these General Terms and Conditions. iBF-next GmbH can use the e-mail address given when ordering to send you newsletters and advertising by e-mail. You have the option of opting out of the newsletter and advertising at any time.

10. Jurisdiction and Applicable Law
Swiss law is exclusively applicable, excluding conflict of laws and international treaties such as the United Nations Convention on Contracts for the International Sale of Goods. The courts at the customer's place of residence or at the registered office of iBF-next GmbH in Lucerne are responsible.
